Annotation

According to the numerous experts, out-of-court and pre-court mediation procedures in China prevail over those settled in court. Adjustment and settlement of disputes happen via negotiations, mediation, and arbitration. Alternative dispute resolution (ADR) is essentially more preferable than court procedures in China. Conciliation commissions are stated in the The Constitution of the People's Republic of China. Mediative techniques in adjustment and settlement of disputes are being introduced in Russia as a new way of labour disputes settlement. The author ponders whether it is possible to employ Chinese mediation procedures in Russia.

Key words: alternative dispute resolution (ADR), mediation, negotiation, arbitration, labour disputes, court, justice, conflict.
