Judges, juries & arbitration assessors play an important role in the implementation of tasks of law enforcement and protection of human rights. The given situation results in the fact that the mentioned officials may suffer from the pressure of interested persons in different ways. On the one hand, the introduced in the Criminal-Procedural Code of the Russian Federation (henceforth - the CPC of the RF) law institute, which regulates issues of criminal proceedings in respect of certain categories of persons, pursued the purpose to protect them from unreasonable charges and restrictions of rights & freedoms by providing additional guarantees for realization of their rights. On the other hand, the annual increase in the amount of prosecuting persons, who have special legal status, as well as their specific legal position & presence of disproportionate benefits, making difficult the achievement of the objectives of criminal process provided by the article 6 of the CPC of the RF.
More effective fight against crimes, committed by judges, juries & arbitration assessors is impossible without scientific improvement of criminal procedure. Moreover, priority should be given to the initial stage ? the criminal case, which created positive conditions for the most favorable process of crime investigation. The result of the preliminary investigation & judicial perspective of the criminal case depend on the reaction to the information, indicating signs of crime, the comprehensive inspection of this information, the timeliness of criminal proceedings. The fulfillment of this task is impossible without a comprehensive knowledge of the relevant procedural characteristics of the criminal case against one category of persons, & the originality of their impact on the legal processes of the initial stage of criminal proceedings.
